Welcome to Guatape Local Tours. By booking a tour with us, you (the “Client”) agree to the following Terms and Conditions. Please read them carefully before making a reservation.
This website (guatapelocaltours.com) and the services offered herein are operated by Land To Enjoy, a duly registered travel agency in Colombia with National Tourism Registry (RNT) number 47826.
For the purposes of this document, the terms “we”, “us”, “our”, “the Agency”, and “Guatape Local Tours” refer directly to Land To Enjoy.
1. Our Role as an Intermediary
Guatape Local Tours acts as a specialized booking agent and intermediary. We expert-select and resell tours operated by trusted third-party local companies in Colombia. While we carefully vet our partners to ensure the highest quality experience, Guatape Local Tours does not directly own the vehicles or employ the ground staff operating the tour.
2. Booking and Payments
- Payment: Full payment is required at the time of booking to secure your seat. We accept major credit and debit cards through our secure payment processor (Stripe/PayPal).
- Currency: All prices are listed and charged in US Dollars (USD).
- Confirmation: Your booking is confirmed only when you receive an automated email confirmation from us with your order number.
3. Pricing and Inclusions
The price of your tour includes transportation, a bilingual guide, breakfast, lunch, a boat tour, and travel assistance insurance for the duration of the trip.
Travel Insurance & Liability: While a basic travel assistance insurance policy is included in the price of your tour, Guatape Local Tours acts solely as an intermediary agent and does not directly issue or administer this insurance policy.
- Operator Responsibility: The travel insurance policy is purchased and managed directly by the third-party tour operator conducting the trip.
- Coverage: This policy typically covers basic medical assistance for accidents that may occur during the transportation and scheduled activities of the tour. It does NOT cover pre-existing conditions, loss of personal items, or incidents that occur during free time if you deviate from the group.
- Claims: In the event of an incident requiring medical attention, you must notify the tour guide immediately so they can activate the operator’s insurance protocol. Guatape Local Tours will assist in facilitating communication but is not liable for insurance claims, coverage decisions, or payouts.
- Data Requirement: To be covered by this policy, you MUST provide the full names and valid identification numbers (Passport/ID) for all passengers in your group before the tour begins. Failure to provide accurate data may result in a lack of coverage, for which Guatape Local Tours bears no responsibility.
Exclusions: The price does NOT include the entrance fee to climb the Piedra del Peñol rock (approx. 30,000 COP, payable in cash on-site), discretionary tips, or extra drinks/snacks not specified in the itinerary.
4. Cancellation and Refund Policy (CRITICAL)
We offer a flexible cancellation policy to give you peace of mind, while also respecting the logistics of our local operators.
- Free Cancellation (Full Refund): If you cancel your booking at least 24 hours before the scheduled tour departure time (7:00 AM local Colombia time), you will receive a 100% refund.
- Late Cancellation (No Refund): Cancellations made less than 24 hours before the tour departure time are non-refundable.
- No-Shows (No Refund): If you are not at the designated pickup point at the scheduled time, the bus cannot wait. This will be considered a “No-Show” and is 100% non-refundable.
To request a cancellation, you must email us at support@guatapelocaltours.com with your order number.
5. Changes to Your Booking
- Date Changes: If you wish to change the date of your tour, you must request it at least 24 hours in advance. Changes are subject to seat availability on the new date.
- Passenger Details: You may update passenger names up to 12 hours before departure free of charge.
6. Pickup and Punctuality Policy
Punctuality is essential for a group tour.
- It is the Client’s responsibility to be at the correct meeting point at least 10 minutes before the scheduled departure time.
- Parque del Poblado: Departure at 7:00 AM sharp.
- Estadio Metro Station: Departure at 7:30 AM sharp.
- We cannot hold the bus for late arrivals, as it affects the experience for all other guests. Missing the departure is considered a No-Show (non-refundable).
7. Children and Infants Policy
- Children (4+ years): Must book a standard seat and will receive full meals.
- Infants (0-3 years): May travel free of charge, provided they sit on a parent’s lap and share meals with their parents. They do not occupy their own seat.
8. Our “Positive Impact” Pledge (Donations)
For every confirmed seat booked, Guatape Local Tours pledges to donate the equivalent cost of 1 pound of food to our partner animal rescue foundation in Guatapé.
- If you cancel your tour and receive a full refund, the corresponding donation will also be cancelled, as the transaction is considered void.
9. Cancellations by the Operator & Force Majeure
In the rare event that the tour operator must cancel the trip due to extreme weather, mechanical failure, or other unforeseen operational issues:
- You will be offered the choice of a full 100% refund OR rescheduling to the next available date free of charge.
- Force Majeure: We are not responsible for delays or changes to the itinerary caused by events beyond our control, such as strikes, severe road closures, civil unrest, or “Acts of God.” In such cases, we will work with you and the operator to find a fair solution, which may include a partial refund or rescheduling.
10. Liability and Conduct
- Conduct: We reserve the right to refuse service to any passenger who is intoxicated, abusive to staff or other guests, or disrupts the safety of the tour. No refunds will be given in these cases.
- Liability: While your booking includes basic travel assistance insurance, Guatape Local Tours is not liable for any personal injury, loss, or damage to personal belongings that occurs during the tour, except where such loss is directly caused by our own gross negligence.
11. Governing Law
These Terms and Conditions are governed by the laws of the Republic of Colombia.
12. Prevention of Child Exploitation (Law 679 of 2001 & Law 1336 of 2009)
In compliance with Colombian Law 679 of 2001 and Law 1336 of 2009, Guatape Local Tours strictly warns the client that the exploitation and sexual abuse of minors in Colombia are severe criminal offenses. Violations are punishable by immediate imprisonment and heavy administrative sanctions under current Colombian laws. We have a zero-tolerance policy and will report any suspicious activity to local authorities.
